Rep. Ugaste Files Bill Allowing for State’s Attorney Recall

Springfield, IL – State Representative Dan Ugaste (R-Geneva) filed a bill today that establishes a procedure for an election to recall a State’s Attorney in counties with a population over 2 million and to elect the recalled State’s Attorney’s successor.

House Bill 5858 was filed in response to Cook County State’s Attorney Kim Foxx’s recent announcement that she is exploring a new policy that would direct prosecutors to not file drug, gun, and theft charges in cases that begin with minor traffic stops.

“This change being considered by State’s Attorney Foxx is reckless, dangerous, and will result in increased crime,” Rep. Ugaste stated. “We need to enact policies that hold those who commit crimes responsible, not ones that embolden them to break the law with no consequences. I believe we need a policy in place to remove a state’s attorney who promotes lawlessness and increased crime in this manner.”

Rep. Ugaste today also filed House Joint Resolution Constitutional Amendment 21, which provides that a State’s Attorney in a county with a population over 2 million may be recalled by petition and referendum of the electors of the county or counties served by the State’s Attorney in a manner provided by law.
